Policy for the Payment and Refund of the Advance Payment

  1. The Patient shall make to the Service Provider an advance payment as a set share of the estimated amount payable for the individual healthcare services to be provided (the ‘Services’), after agreeing with the Service Provider on the date and time of the surgery/procedure, in order to secure the conclusion of the Agreement on the Provision of Individual Healthcare Services under which the Patient buys and the Service Provider renders individual healthcare services the final scope and the final price of which shall be set after the Patient receives the doctor’s consultation and in order to prevent potential losses of the Service Provider in relation to the planning of the staff working loads and schedules and of occupancy of operating rooms and/or other premises (of any kind) and costs of maintenance thereof (the ‘Losses’).
  2. By making the advance payment the Patient confirms that he/she is aware of the estimated price of the Services. 
  3. On conclusion of the Agreement on the Provision of Individual Healthcare Services, the amount of the advance payment made by the Patient shall be set off against the estimated price under the Agreement on the Provision of Individual Healthcare Services. 
  4. The advance payment shall be made within 7 (seven) calendar days after the confirmation of the date of the surgery. 
  5. Where 3 (three) or fewer calendar days remain until the provision of the Services, the Patient shall pay the full price for the Services on the day of signature of the Agreement on the Provision of Individual Healthcare Services.
  6. Should the Patient fail to make the advance payment at agreed time before the scheduled surgery, the booking of the surgery shall be cancelled and the surgery shall not be performed. The Patient shall be informed about the cancellation. 
  7. Should the Patient refuse to sign the Agreement on the Provision of Individual Healthcare Services after making the advance payment, the amount of the advance payment shall be retained by the Service Provider.
  8. The Patient shall have the right to postpone the scheduled surgery until a later date according to the following policy:
    1. In the case of first postponement until a later date (except in case of unforeseen circumstances referred to in Clause 11), the Patient shall indemnify the Service Provider for the Losses in the amount of EUR 100 (one hundred euros). The said amount shall be deducted from the advance payment made by the Patient
    2. In the case of second postponement until a later date (except in case of unforeseen circumstances referred to in Clause 11), the advance payment made by the Patient shall be applied to indemnification for the Service Provider’s losses in full and shall not be refunded. In such a case, if the Patient still wishes to receive the Services from the Service Provider, the Patient must pay the set advance payment amount anew, to secure the performance of the Agreement on the Provision of Individual Healthcare Services and to prevent the Losses.
  9. Should the Patient, after making the advance payment, inform the Service Provider about cancellation of the Surgery when more than 3 (three) weeks remain until the Surgery (except in case of unforeseen circumstances referred to in Clause 11), the Patient shall indemnify the Service Provider for the Losses incurred, which shall be deemed to be equal to one-half (50%) of the advance payment amount paid by the Patient. In such a case the Service Provider shall refund to the Patient 50% of the advance payment amount paid. 
  10. Should the Patient, after making the advance payment, inform the Service Provider about cancellation of the Surgery when less than 3 (three) weeks remain until the Surgery (except in case of unforeseen circumstances referred to in Clause 11), the Patient shall indemnify the Service Provider for the Losses incurred, which shall be deemed to be equal to the advance payment amount paid by the Patient. The advance payment made by the Patient shall be applied to indemnification for the Service Provider’s losses in full and shall not be refunded.  
  11. In the event of the Patient’s inability to arrive for the scheduled Surgery due to unforeseen circumstances (cancelation of the flights by airline company, illness, death of a family member or a close person, or other important circumstances which could not be foreseen or controlled at the time of planning and booking the date and time for the Surgery), the Surgery shall be postponed until a future date as agreed by the parties, provided that the Patient has submitted supporting documents to and notified the Service Provider in writing or via email (i. e. by a method that allows identification of the date of receipt of the notice. Where the Patient cannot postpone the Surgery, the matter of the advance payment shall be decided by agreement of the parties. 
  12. If the Service Provider refuses, after the date of the advance payment made by the Patient, to conclude the Agreement on the Provision of Individual Healthcare Services without the Patient’s fault, the Service Provider shall refund the advance payment amount to the Patient in full.
